East Fraser Fiber Co. Ltd. (“East Fraser”) appealed a stumpage rate determination with respect to a cutting permit issued under a timber sale licence. By consent of the parties, the Commission ordered that the determination be referred back to the Ministry of Forests employee who made the determination, with directions to make a new determination by using a salvage sale variable of “yes” as was originally submitted by East Fraser.
Accordingly, the appeal was allowed.
